Title Parliamentary immunity and hate speech in Brazil
Imunidade parlamentar e discurso de ódio no Brasil

Creator Ceia, Eleonora Mesquita

Description The present article discusses the relationship between the institute of parliamentary immunity and the fundamental right of freedom of speech from a systematic interpretation of the principles laid down in the Brazilian Constitution of 1988. The main hypothesis of the work is that in Brazil the parliamentary immunity does not include the so-called hate speech, which configures an unlawful manifestation of thought according to the Brazilian Constitution. The recent jurisprudence of the Brazilian Supreme Federal Court confirms this hypothesis in providing that the nature of the parliamentary immunity is not absolute and consequently it can be weighed against the principle of human dignity.
