This article addresses the issue of the fundamental right to academic freedom in Spain, in the field of non-university education, both in public and prívate education. The article parts from the evolution of the term from its origin in Central Europe and its application exclusively in the university environment to continue with its treatment in Spain in the current Constitution. The Constitutional Court has established jurisprudence in the subject, establishing academic freedom for all teachers. However, the limits of this right in non-university education (both in public and private education) are so wide –especially at non-compulsory levels– that academic freedom, in its original definition of the term, it becomes practically a fiction and a synonym of what the initiators of the term called pedagogical freedom.
El presente artículo aborda el tema del derecho fundamental de la libertad de cátedra en España, en el ámbito de la enseñanza no universitaria, tanto en la educación pública como en la privada. Se parte de la evolución del término desde su origen en Centro Europa y su aplicación con exclusividad en el ámbito universitario para continuar con su tratamiento en España en la Constitución actual. El Tribunal Constitucional ha sentado jurisprudencia en la materia, estableciendo la libertad de cátedra para todos los docentes. Sin embargo, los límites de este derecho en la enseñanza no universitaria (tanto en la enseñanza pública como privada) son tan amplios –especialmente en los niveles no obligatorios– que la libertad de cátedra, en su definición primigenia del término, se convierte prácticamente en una ficción y en un sinónimo de lo que los iniciadores del término denominaron libertad pedagógica. |
