In Brazil there is an estimated population of about 140 million animals present in the family nucleus. In the Federal District there are approximately 1.5 million animals that integrate the multispecies family (new family conformation), which starts to interpret these animals under the logic of ethics and affection, calling them companion animals. This new family structure generates social and legal consequences (example: the existence of discussion about the shared custody of animals after the dissolution of the family nucleus) that end up resulting in the need for state action (by one of its constituted powers). In this context, an exploratory and descriptive study of the judicial panorama in the Court of Justice of Federal District related to companion animals was carried out. It was verified the existence of court decisions that protect animals (especially due to the constitutional prohibition of cruel practices) and permeate the breaking of the current anthropocentric paradigm, although there is also a preponderance of these issues exclusively in relation to dogs and cats. This situation can be explained by the closer affective relationship existing between these companion animals and human beings within the multispecies family. It is expected that the panorama presented is one more element for the understanding of animals in society and that Animal Rights continues to evolve in the Federal District and in Brazil, also resulting in a greater understanding by human beings and, consequently, in a greater protection of animal integrity and dignity.
No Brasil existe uma população estimada de cerca de 140 milhões de animais presentes no núcleo familiar. No Distrito Federal há aproximadamente 1,5 milhão de animais integrando a família multiespécie (nova conformação familiar), que passa a interpretar esses animais sob a lógica da ética e do afeto, denominando-os animais companheiros. Essa nova conformação familiar gera desdobramentos sociais e jurídicos (exemplificativamente: a existência de discussão sobre a guarda compartilhada de animais após a dissolução do núcleo familiar) que acabam resultando na necessidade de uma ação estatal (por um de seus poderes constituídos). Nesse contexto, realizou-se um estudo exploratório e descritivo do panorama judicial no Tribunal de Justiça do Distrito Federal e dos Territórios relacionado aos animais companheiros. Verificou-se a existência de decisões judiciais que protegem os animais (especialmente em virtude da proibição constitucional de práticas cruéis) e perpassam pela quebra do paradigma antropocêntrico vigente, embora se observe também uma preponderância dessas questões exclusivamente em relação a cães e gatos. A referida conjuntura pode ser explicada pela relação afetiva mais próxima existente entre esses animais companheiros e os seres humanos no bojo da família multiespécie. Espera-se que o panorama apresentado se configure como mais um elemento para a compreensão dos animais na sociedade e que o Direito Animal, continue evoluindo no Distrito Federal e no Brasil, resultando também em uma maior compreensão pelos seres humanos e, consequentemente, em uma maior proteção da integridade e da dignidade animal. |
