The different motives of the creditor and the debtors caused the different understanding of the parate execution. This is due to the regulation of parate execution in Fiducia Guarantee Law (UUJF) regarding to the implementation mechanism for the execution is not regulated clearly and in detail, so that in practice there are many legal problems for the fiducia guarantee execution. Until then, the execution of the fiducia guarantee problem up to the trial at the Constitutional Court of the article 15 (2) (3) UUJF related to the parate execution, then later in its decision the Constitutional Court declared the article is conditionally unconstitutional. This article aims to determine the urgency of the parate execution in fiducia guarantees and the need for amendment (reconstruction) of the UUJF that regulates the new concept of the parate execution which is more guarantee the creation of legal certainty and the fulfillment of the just law. This article is the result from normative juridical research wherein the approach of the problem is carried related to the provisons of the parate execution. This results of this research shows the important existence of the parate execution in the execution of the fiducia guarantee on the grounds of the legal certainty, effectivity and efficiency in the execution, as well as the reason for the investment climate so that a legal reconstruction is needed to provides legal certainty for the execution process of the fiducia guarantee with consideration of fast time and low cost.
