The increase of sexual violence against children within the last 5 years is considerably worrying. Every country including Indonesia has tried various strategies to tackle this crime. Under Article 81 paragraph (5) Law No. 17 of 2016, chemical castration has been opted by Indonesia to address the perpetrator of sexual violence against children. The existence of this additional sanction in fact has reaped the pros and cons in the society, notably regarding the risks, benefits, and fairness of the imposition of this sanction. Moreover, this sanction cannot automatically be implemented due to the absence of government regulation governing its implementation. This paper is generated from normative research by using statutes and conceptual approaches. The aim of this study is to measure the benefit and fairness aspects of the imposition of chemical castration sanctions against perpetrators of sexual violence against children. The result shows that the existence of chemical castration has not been reflecting the aspects of benefit and fairness due to the risks resulted from this sanction is greater than its benefits in reducing child sexual violence pragmatically. Hence, chemical castration can not be regarded as a preventive tool, other than an emergency exit provided by the government instead.
