This work addresses the study of the treatment of bullying in the regulations and protocol of the Basque Country with the intention of providing some guidance to the problems raised by its application. In particular, it asks whether the protocol applies only in public centers or also in private centers and whether the actions covered by it are understood to constitute the prior information provided for in Law 39/2015, of 1 October. Is also discusses the possibility to access the actions that constitute this prior information, how the actiones referred to in the protocol should be carried out, the deadline for holding the first meeting under the protocol, tha possibility to record the meetings that constitute actiones provided for in the protocol and the applicability of the principles and guarantees of the administrative procedure to these actiones provided for in the protocol El presente trabajo aborda el estudio del tratamiento del acoso escolar en la normativa y protocolo del País Vasco con la intención de ofrecer algunas orientaciones a los problemas que suscita su aplicación. En concreto, se plantea si el protocolo es de aplicación sólo en los centros públicos o también en los centros privados y si se entiende que las actuaciones que éste contempla puede considerarse que constituyen la información previa prevista en la Ley 39/2015, de 1 de octubre. Asimismo se analizan la posibilidad de acceso a las actuaciones que constituyen esta información previa, la forma en que se deben realizar las actuaciones contempladas en el protocolo, el plazo para la celebración de la primera reunión prevista en éste, la posibilidad de grabación de las reuniones que constituyen actuaciones previstas en el protocolo y la aplicabilidad de los principios y garantías del procedimiento administrativo a estas actuaciones previstas en el protocolo. |
